The Law Office of Todd Cushner & Associates, PC is representing Dr. Perry Frankel in a lawsuit against Aetna Insurance Co, a health insurance provider for transit workers and other unions in the City of New York. The Firm is submitting an Order to Show Cause to reinstate Dr. Frankel when the company terminated his contract absent any reasonable explanation.
Dr. Frankel is a New York licensed physician and is Board Certified in Internal Medicine and Board Eligible in Cardiology, with medical staff privileges at North Shore University Hospital, St. Francis Hospital and Lenox Hill Hospital. Dr. Frankel’s medical practice, Advanced Cardiovascular Diagnostics (ACD) is a New York corporation that provides state-of-the-art cardiovascular testing and cardiovascular disease prevention services in three office settings located in Lake Success, the Bronx and Brooklyn as well as two fully equipped mobile clinics.
The mobile clinics are highly effective in providing healthcare to union workers, government agencies, churches and charitable organizations throughout the New York City area. Primarily, the mobile clinics provide healthcare to members in low-income areas in NYC who lack access to quality medical services.
Many union workers – the people that drive our NYC buses and trains so that we can get to/from our place of business – work long hours and overnight shifts. Thus, Dr. Frankel’s mobile clinic is highly effective in providing access to life saving healthcare for these union workers. Over the years, the mobile exam units have saved countless lives, allowing members to receive preventative care that improves their overall health and reduces the need for them to incur future costly medical procedures related to strokes, heart attacks, heart blockages, aneurysms and other serious medical conditions.

Unions Angered by Aetna
Union leaders are outraged that Aetna barred Dr. Frankel from giving their members lifesaving cardiovascular testing and medical services and have agreed to find a different healthcare provider if Aetna doesn’t reconsider their decision to remove Dr. Frankel from the list of providers. In fact, five New York City MTA union leaders voiced their support of the efforts of Dr. Frankel and protested his termination from Aetna’s list of providers. Among the unions who signed the letter were Subway-Surface Supervisors Association, and Transport Workers Union Local 100 and 106, collectively representing over 55,000 members. Many other union representatives wrote letters as well, including social service employees from Local 347. The letters simply state that the loss of Dr. Frankel’s services will affect the health and welfare of their members who rely on this unique opportunity of mobile exam units. The letters are a clear indication that union leaders recognize the importance of access to life-saving testing that Dr. Frankel provides.
The Law Office of Todd Cushner & Associates had several letters of recommendation written by the facilities that used Advanced Cardiovascular Diagnostics for their staff members. Such companies included NYC Department of Correction, the 6th Senatorial District, All Saints Regional Catholic School, and NYC Civil Service Employees Local 983.
